ATLANTIC BRIDGE CORPORATION, a California corporation and any of its respective affiliates (collectively, “ABC,” “we,” “us,” or “or”) operates a website, including any online portal, mobile application, other customer account, content, feature, or functionality available at https://www.atlanticbridge.com/ (the “Website”). ABC respects your privacy and remains committed to ensuring transparency in how your personally identifiable information is being collected, used, and disclosed when you interact with the Website or otherwise engage us for certain services. 

The following information serves as ABC’s privacy policy (“Privacy Policy”) and describes how your personally identifiable information may be collected when you visit the Website, access our services, enroll through our online application, or otherwise interact with ABC. It also describes how your personal information is used, disclosed to other parties, and protected from unauthorized use or disclosure. Specific services might use or require different personal information practices than are described in this Privacy Policy, and those policies and practices will be disclosed at the time of collection. 

Please carefully read this Privacy Policy and the Terms of Use, which is incorporated herein by reference, and any other terms and conditions ABC may have provided you with when collecting your personally identifiable information or otherwise engaging with you. 

  1. CONSENT TO PRIVACY POLICY

By accessing or using the Website, using the mobile application, engaging ABC for certain services, or otherwise providing personally identifiable information to ABC by any means, you agree to the terms of this Privacy Policy and the Terms of Use.

  1. APPLICABLE LAW

The Website was created by and is controlled, operated, and administered by ABC or its agents from offices within the United States of America, utilizing servers located in the United States of America. We make no representation that materials on the Website are appropriate or available for transmission to or from, or use in, locations outside of the jurisdiction stated above, and accessing the Website from any jurisdiction where the Website’s contents are illegal is prohibited. You may not use the Website or export the materials in violation of import or export laws and regulations. If you access the Website from a location outside of the United States, you are responsible for compliance with all local laws.  If you are located outside of the United States, please note that the personally identifiable information you provide to us will be transferred to the United States. Whenever you submit any personally identifiable information to us, you consent to this transfer.

Additionally, the applicable laws of our affiliated academic institutions may differ from the applicable laws of the United States. We do not express any opinion as to your rights, privileges, and duties under such applicable laws, and we advise you to consult your own attorney on such matters.

This Privacy Policy complies with the California Online Privacy Protection Act (“CalOPPA”), California’s Shine the Light law, Canada’s Personal Information Protection and Electronic Documents Act (“PIPEDA”), and the European Union’s General Data Protection Regulation (“GDPR”).

  1. PERSONAL INFORMATION

Personally identifiable information refers to individually identifiable information about you that we collect online and maintain in an accessible form. The personally identifiable information that we may collect from you may include your name, address, phone number, email address, fax number, IP address, age, date of birth, gender, occupation, marital status, number of children, spouse’s name and occupation, parents’ names, occupations, and contact information, criminal history, academic transcripts and information, medical records and information, or information pertaining to an academic program, mailing list, application requests made, mobile application use (including location data), requests for customer service, online registration, or financial account when associated with a person’s name. Personally identifiable information does not include aggregate personal information, which is information that we collect about a group or category of persons or services, or de-identified information, which is information that ABC or our agents have removed any information that can be used to specifically identify you. 

This Privacy Policy does not restrict or limit our collection or use of aggregate personal information or de-identified information.

  1. COLLECTION OF PERSONALLY IDENTIFIABLE INFORMATION

ABC may collect your personally identifiable information through one or more of the following methods: 

  1. Personally Identifiable Information You Provide. ABC may collect personally identifiable information from you voluntarily, when you register as a user of the Website, sign up for or use our admission services, enroll in our marketing programs, contact us electronically (by email, phone, or the Website), use our mobile application, or otherwise communicate with us. We do not automatically collect any personally identifiable information from you when you visit the Website without inputting, submitting, or sending us any of your personally identifiable information. You may voluntarily provide personally identifiable information to us through an information request, registering an account, or providing information on an application. For example, if you contact us regarding admission registration, we may request that you provide personally identifiable information that will enable us to respond to your inquiry.  If you do not provide such information, we may not be able to respond to your inquiry, or your participation in our programs may be limited.
  2. Automatic Collection. When you register for or use our admission services, in addition to the personally identifiable information you voluntarily provide to us, we may automatically collect certain transactional information from you (e.g., the date of your application, registration, or service usage; descriptions of your application, registration, or service usage; and the dollar amount or value of your application or registration). When we use or disclose this transactional information in combination with or linked to your personally identifiable information, we will treat the transactional information as if it is personally identifiable information.
  3. Information Collected Through Marketing Efforts. We may obtain personally identifiable information about you from third parties such as demographic marketing information, address verification, or mailing list information and combine it with other personally identifiable information pertaining to you. Please be sure you read and understand the privacy practices and policies of third parties that you share your personally identifiable information with.  
  4. Cookies, Web Beacons, and Similar Technologies. We may use cookies, web beacons, and similar technologies to manage the Website, mobile application, and email messages, and we may collect information about your online activities through the Website and our mobile application. We may link this information with other personally identifiable information pertaining to you. By continuing to visit the Website, you agree to the placement of cookies on your device. If you choose not to accept the cookies, we cannot guarantee that you will have access to the full experience, goods, and services offered on and through the Website.
  5. Third Parties. ABC is not a part of a third party tracking network and does not allow third parties to collect personally identifiable information about consumer’s online activities through the Website. During the admission process, our affiliated educational institutions may request additional information on your health and criminal history, which ABC does not collect or receive. This information is subject to such affiliated educational institutions’ applicable local laws (which may differ from the country in which you reside) and policies. This Privacy Policy only applies to the personally identifiable information that we collect directly from you, and we are not responsible for third parties’ practices when they collect your personally identifiable information. Again, we encourage you to check the privacy policies of such third parties to learn about their practices with respect to the collection, use, disclosure, and protection of your personally identifiable information.
  1. USE OF PERSONALLY IDENTIFIABLE INFORMATION

ABC may use your personally identifiable information for a variety of purposes, including:

  1. Responding to your comments, requests, and questions regarding our services;
  2. Processing and completing your application requests, including the delivery of your personally identifiable information to the academic institutions that you select and confirm should receive your application data;
  3. Attempting to contact you regarding application requests and potential admissions and application related issues;
  4. Sending you technical notices, updates, security alerts, and support and administrative messages;
  5. Verifying your identity for security purposes;
  6. Keeping a record of our interactions and communications with you if you place an application request or otherwise engage with our representatives over the telephone or online; 
  1. Conducting statistical and demographic analysis for our own business operations, marketing, and other internal uses; 
  1. Preventing, investigating, or providing notice of fraud, unlawful or criminal activity, or unauthorized access to or use of personally identifiable information, the Website or data systems, or to meet legal obligations; 
  2. Protecting and defending ABC and its affiliates against legal actions or claims;
  3. Collecting debts;
  4. Satisfying contractual obligations;
  5. Evaluating your application request; 
  6. Cooperating with law enforcement or other government agencies for purposes of national security, public safety, or matters of public importance when we believe that disclosure of information is necessary or appropriate to protect the public interest or as otherwise required by law;
  7. Conducting market research, surveys, and similar inquiries to help us understand trends and customer needs across service categories or customer groups;
  8. Evaluating and improving your application experience, online experience, existing services, or new services;
  9. Communicating specials and discounts via email;
  10. Applying discounts for any marketing program specials offered to you or used by you when you apply;
  11. Monitoring and analyzing trends, usage, and activities; and
  12. Performing any other purpose disclosed elsewhere in this Privacy Policy.

When it is possible to do so, we may link personally identifiable information with non-personal information. We may also link personal information with other generally or publicly available information to help us identify your preferences or interests. The information we collect may also be merged with information available from other sources such as (1) companies that match e-mail addresses with postal addresses and other information; (2) credit card verification and credit services; and (3) our affiliates.

We will only send your personally identifiable information to our affiliated educational institutions at your direction or with your verified request. In those cases, our affiliated educational institutions may also contact you or send you information during the admissions process. ABC does not control the communications and privacy of such communications and your personally identifiable information as it pertains to you and the affiliated educational institutions you apply for. Please refer to the privacy policy of each respective institution for more information.

  1. DISCLOSURE OF PERSONAL INFORMATION

ABC may disclose your personally identifiable information to its affiliates. ABC does not sell or rent your personally identifiable information to third parties in the ordinary course of business. Notwithstanding the foregoing, upon the occurrence of certain corporate transactions, your personally identifiable information may be disclosed or transferred as described below. Our practices with respect to the disclosure of personally identifiable information are described below or as otherwise stated in this Privacy Policy.

  1. With Your Consent. We may disclose your personally identifiable information to select academic institutions and other third parties with your consent. You may give your consent in several ways, such as through a written agreement that you sign or acknowledge; an online method, such as a “click-through” agreement or registration page; an oral statement, such as by way of an interactive voice response or orally authorized consent during a phone call; or through the terms and conditions under which we provide you with application requests. Sometimes your consent may be implicit. For example, if you complete an application request with a credit card, you implicitly consent to the disclosure of your name and credit card number to the credit card processor to authorize the transaction.
  2. Service Providers. We may disclose your personal information to third parties who complete transactions or perform services on our behalf or for your benefit. Information provided to such parties for payment authorization (including PayPal, Payeezy, and credit card information processors) or verification purposes may be retained by them in a database that is used to provide similar services to others. We may also utilize third party services to verify customer data, such as mailing addresses or to supplement other information we have collected. We may also contract with third parties to host a website, retain customer data, conduct market research, or send you information regarding our services, or those of other companies with whom we conduct business.
  3. Legal Processes. We may disclose your personally identifiable information to legal or government regulatory authorities in response to their requests for such information or to assist in investigations of theft, fraud, or abuse. We may also disclose your personally identifiable information to third parties in connection with claims, disputes, or litigation, or if we determine its disclosure is necessary in an emergency. This may include the disclosure of IP addresses, mobile device identifiers, or other information collected by us, with or without notice to you.
  4. Certain Business Transfers. Your personally identifiable information may be disclosed as part of an actual or proposed corporate business transaction, such as a merger, acquisition, joint venture, or financing or sale of company assets, and could be transferred to a third party as one of the business assets in such a transaction. It may also be disclosed in the event of insolvency, bankruptcy, or receivership.
  1. PAYMENT INFORMATION

We may also ask you for financial information for payment purposes, including your billing name; billing address; credit, debit, or bank card, or PayPal account information; or any other information that we, in our sole discretion, deem appropriate (“Payment Information”). We will not store your Payment Information on our database. Once you provide us with your Payment Information, we will forward the information to our third party payment processor, who will only use your Payment Information to process your payment of the ordered products and services.

  1. INFORMATION PERTAINING TO CHILDREN

ABC is the only operator of the Website, and its contact information is listed in Section 17 below. ABC does not knowingly or intentionally collect personally identifiable information from children under the age of 13, and has taken steps to avoid doing so through the Website. Accordingly, ABC does not enable children to make their personally identifiable information publicly available, knowingly or intentionally use their personally identifiable information in any manner, or knowingly or intentionally disclose their personally identifiable information to anyone. If a child under the age of 13 has or may have provided personally identifiable information to ABC, a parent or guardian may inform us of that fact by contacting us using one of the methods listed in Section 17 below, and we will then review our records and delete any such information from our database. If you are under the age of 13, do not provide us with any personal information either directly or indirectly (e.g., by posting or submitting personal information on the Website). Any personal information that we receive from a person whom we believe is under the age of 13 will be deleted.

Users under the age of 18 must have the consent of their parent(s) or adult guardian(s) to complete ABC’s online application. Such users’ parent(s) or adult guardian(s) must complete the “Parent/Guardian Signature” to complete ABC’s online application process.

  1. ACCESS TO AND RETENTION OF PERSONAL INFORMATION

ABC does not maintain all your personally identifiable information in a form that you can access or update, and some items, such as transaction records, may not be changed. Accordingly, we will determine and may limit what may be accessed and how, subject to applicable law, and we may keep a record of changes (including deletions) and disclose them for legal compliance or other lawful purposes. We retain your personally identifiable information for only as long as necessary to fulfill the purpose for which it was collected or as long as required by law, whichever is longer. Upon our confirmation of your identity, you may request confirmation that your application is being processed, review your personally identifiable information that is readily accessible free of charge (provided that such request is not excessive or unfounded), or request that it be updated by contacting our ABC Customer Service Center using one of the methods listed under the Section 17 below.

  1. SECURITY OF PERSONAL INFORMATION

ABC uses various physical, electronic, and procedural measures to protect your personally identifiable information from unauthorized disclosure or misuse. Only authorized employees of ABC have access to our databases where your personally identifiable information is stored. We employ Secure Sockets Layer (SSL) and HTTP Secure (HTTPS) technology and other security measures to encrypt and securely transfer sensitive personally identifiable information you input, such as credit card numbers, during transmission. However, because no data security systems are completely secure, we do not warrant that any personal information that you provide to us will be secure or safe from unauthorized access.   1. LINKS TO OTHER WEBSITES

The Website may contain links to websites operated by third parties. We may, from time to time, at our sole discretion, add or remove links to other websites. These links are provided solely as a convenience to you, and access to any such websites is at your own risk. Your business dealings, communications with, or participation in promotions with such websites (other than ABC) and any terms, conditions, warranties, or representations associated with such dealings are solely between you and such third parties. When you visit their websites, they may collect information about your visit and use it to provide advertisements to you. This Privacy Policy does not apply to, and we are not responsible for, the practices of third parties that collect your personally identifiable information. Each of these linked websites may maintain its own policies about the collection, use, and protection of your personally identifiable information. We encourage you to check the privacy policies of such third parties to learn about their practices. 

  1. CHANGES TO THIS POLICY

ABC will modify this Privacy Policy if our practices change. We will notify you of such changes by posting a modified version of this Privacy Policy, with a new effective date, on the Website. We encourage you to visit the Website periodically to view the latest version of the Privacy Policy.

  1. OPT-OUT CHOICES

The Website does not respond to “do not track” signals or similar mechanisms. ABC may send you email messages, direct mail offers, or other communications regarding products or services unless you specifically ask us not to do so when you enroll in our marketing program, access the Website, or change your preferences by updating any accounts you may have with us. At any time, you may elect to discontinue receiving commercial messages from ABC by submitting an opt-out request to our ABC Customer Service Center (see Section 17 below) or by following the instructions in the form of the communication you received, as described below.

  1. Emails: To opt out of receiving marketing materials via email, use the method provided in the emails or contact us at info@atlanticbridge.com.
  2. Printed Materials: To opt out of receiving printed marketing materials at your postal address, such as catalogs, flyers, or postcards, contact us at info@atlanticbridge.com.
  3. Voice Messages: To opt out of receiving voice messages by telephone, you may follow the instructions stated in the pre-recorded voice message or contact us at info@atlanticbridge.com.
  1. CALIFORNIA PRIVACY RIGHTS

Because we value your privacy, we have taken the necessary precautions to be in compliance with CalOPPA and Shine the Light law. We therefore will not distribute your personal information to outside parties without your consent, with the exception of certain limited circumstances described in this Privacy Policy. This consent may be explicit, such as your selection of a certain academic institution to which you would like to submit your application, or implicit, such as your use of a third-party vendor’s payment system (e.g., Paypal, Payeezy, or other major credit card processor). Please note that the California Shine the Light law does not cover all information sharing. Our disclosure only includes information covered by the law. 

Although ABC is headquartered in California, we do not meet the revenue, data-volume, or data-sale thresholds outlined in the California Consumer Privacy Act of 2018, as amended (“CCPA”), and therefore, we are not subject to the CCPA. 

  1. CANADA PRIVACY RIGHTS 

ABC collects, uses, and discloses your personally identifiable information in a reasonable manner in accordance with PIPEDA. ABC aims to follow PIPEDA fair information principles. 

As noted above, by engaging with us, providing us with your personally identifiable information, or otherwise entering into an agreement with us or utilizing our services, you consent to ABC’s collection, use, and disclosure of your personally identifiable information in accordance with this Privacy Policy. 

We only collect the personally identifiable information that is necessary to fulfill the purpose for which it is being collected. In accordance with PIPEDA, we outline the purposes for which we collect your personally identifiable information in Section 5 above. We will not use your personally identifiable information for purposes other than those outlined in this Privacy Policy, except with your consent or as required by law.

Unless an exception is applicable under PIPEDA or another applicable law, upon your request, ABC will: 

  1. Advise you on the personally identifiable information about you that we collect, use, or disclose.
  2. Explain where the personally identifiable information was obtained.
  3. Explain how your personally identifiable information is or has been used and to whom it has been disclosed.
  4. Give you access to your personally identifiable information at minimal or no cost or explain our reasons for not providing access. 
  5. Correct or amend personally identifiable information that is incorrect or incomplete, if necessary and feasible.

If you have any questions, concerns, or want to exercise your rights under PIPEDA, please contact us using the information in Section 17 below. You will be able to communicate with ABC’s designated privacy officer. 

  1. EUROPEAN UNION PRIVACY RIGHTS

This section applies to you if we are collecting and processing your personally identifiable information while you are in the European Union. In compliance with the GDPR, ABC’s data collection and processing practices are lawful, fair, and transparent. As noted above, in most cases, we only collect and process personally identifiable information that you consent to or voluntarily provide to us to use our services. You may withdraw such consent to the processing of your personally identifiable information at any time. 

ABC processes personally identifiable information as both a “processor” and as a “controller,” as defined in the GDPR. ABC will be the controller for user data as outlined above in Section 4. ABC will be the processor in accordance with the GDPR as outlined in Section 5 above. All personal information collected will be hosted in secure hosting facilities in accordance with the highest security regulations.

The GDPR provides for certain rights to “data subjects” or natural persons who are in the European Union. To exercise any of the rights summarized below, please use our contact information in Section 17. 

  1. Right of access: You have the right to obtain confirmation from ABC whether certain personally identifiable information concerning you is being processed.
  2. Right to rectification: You have the right to obtain from ABC, without undue delay, the rectification of inaccurate personally identifiable information concerning you, including having incomplete personally identifiable information completed.
  3. Right to erasure: This right is also known as the “right to be forgotten.” You have the right to obtain erasure of personally identifiable information concerning you, without undue delay, and ABC must delete such information without undue delay, subject to certain exceptions provided by the GDPR. If we have sent your application to any requested educational institution, we will notify such educational institution(s) of the request for erasure. 
  4. Right to restriction of processing: You have the right to restrict ABC from processing your personally identifiable information if you believe the personally identifiable information is inaccurate; the processing is unlawful and you do not want to request erasure of your personally identifiable information; ABC no longer needs your personally identifiable information for processing purposes, but you need it for the exercise or defense of legal claims; or you objected to processing pending verification of whether ABC’s grounds override yours. 
  5. Right to data portability: You have the right to receive the personally identifiable information that you have provided to ABC, in a structure, commonly used, and machine-readable format, and you have the right to transmit that information to another controller under limited circumstances and where technically feasible.
  6. Right to object: You have the right to object to the processing of your personally identifiable information that is being used for certain purposes, and unless ABC has compelling legitimate grounds for processing that override your interests, we will no longer process your personally identifiable information when you exercise this right. 
  7. Right not to be subject to a decision based solely on automated processing: You  have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects concerning you or significantly affects you, except if the decision is necessary to perform the contract you entered into with ABC; as authorized by law with safeguards to protect your interests; or based on your explicit consent. 

By submitting an application or contact form through the Website, you provide your informed consent to the transfer of your personally identifiable information to our servers in the United States. The transfer is necessary for ABC to process your application.

We retain your personally identifiable information for only as long as necessary to fulfill the purpose for which it was collected or as long as required by law, whichever is longer. 

In addition to the rights above, you have the right to lodge a complaint against us with a supervisory authority.
